The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 24.09.2020 in connection with Crime No. 370/2020 registered in Police Station- Bhatapara (City), Baloda Bazar - Bhatapara (CG) for the offence punishable under Sections 365, 376 (d), 343, 506B, 366, 370, 120B read with Section 34 of IPC.

2. At the very outset, learned counsel for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

3. Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
