1. The appellant has filed this appeal against the judgment of conviction and order of sentence dated 19.10.2012 rendered by Additional Sessions Judge, Durg C.G. in S.T.

CRA No. 1229 of 2018 No.269/2011 whereby and whereunder the appellant has been convicted under Section 302 of the I.P.C. and sentenced him to undergo life imprisonment.

2. The report has been received from the Superintendent of Central Jail, Durg informing that sole appellant - Baikuntha Yadav son of Goutam Yadav has died on 06.04.2019.

3. The legal heirs/ dependants of the sole appellant have not moved any application seeking permission to prosecute the appeal.

4. In the above circumstances, the instant appeal is dismissed as abated.
