1. Heard.
2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.175/2016, registered at Police Station Kotwali, District Rajnandgaon (CG) for the offence punishable under Sections 420, 467, 468 & 120 of IPC.
3. As per the prosecution case, co-accused Dileep and one Manbai are joint holders of the subject land. However, Dileep sold the land in favour of one Vikas Gupta by presenting co-accused
Munnibai Mochnin to impersonate Manbai. The applicant appended his signature as a witness to the sale-deed dated 02.07.2014.
4. Considering the fact that the applicant is neither the executor nor beneficiary of the transaction, as he appeared only as a witness to the sale-deed as also for the reasons that the offences are triable by the Judicial Magistrate First Class and the applicant is in jail since 19.3.2017, this Court is inclined to release the applicant on regular bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
