Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 10/02/2021

1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.453/2020, registered at Police Station Arang, District- Raipur C.G. for the offence punishable under Sections 420, 467, 468, 471 of the I.P.C.

2. Applicant obtained service as Shiksha Karmi Grade III in 2008, on the basis of forged marksheet of higher secondary. The fraud became known to the Police when the applicant

MCRC No. 8171 of 2020 had obtained Rs.3,50,000/- from the complainant Thamu Ram for arranging employment for him but, did not return the amount. However, the present crime concerns obtaining service on the basis of forged marksheet only.

3. Learned State counsel would oppose the prayer for grant of bail.

4. Considering the entire fact situation of the case and also for the fact that the applicant is in jail since 07.10.2020; charge sheet has already been filed and the offences are triable by JMFC, I am inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
