1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.539/2020 registered at Police Station Sarakanda, Bilaspur for the offence punishable under Sections 294, 506, 323 & 307 of the IPC.

3. For an incident involving eating of fruits by cow, a dispute arose between the applicant on one side and injured Ramdas, his brother Bhagwandas (informant) & one Shyamdas on the other

MCRC No. 8383 of 2020 side. After brief altercation, the applicant went back to his house and returned with a Chapad in his hand and assaulted Ramdas, which injured his wrist while he was trying to save himself. The applicant gave another blow which caused injuries over the head of the injured.

4. Considering the entire facts situation of the case, I am not inclined to release the applicant on regular bail at this stage.

5. Accordingly, the bail application is dismissed with liberty to the applicant to revive the prayer after examination of the victim. Sd/- (Prashant Kumar Mishra) Judge Shyna
