1. Proceedings of this matter have been taken up through video conferencing from High Court premises at Bodri, Bilaspur.
2. Leaned counsel for the petitioner submits that against the order of confiscation
passed by the Collector under the provisions of Section 47A of the Chhattisgarh Excise Act, the appeal would lie before the Appellate Authority under Section 47B of the Act. Therefore, he may be granted liberty to file fresh appeal under Section 47B of the Act.
3. It is not opposed by other side.
4. Accordingly, the petitioner is granted liberty to prefer an appeal before the Appellate Authority under Section 47B of the C.G. Excise Act. If the petitioner files appeal within 30 days from today, the Appellate Authority will do well to consider and decide the same in accordance with law.
5. With the aforesaid observation, the CRMP finally stands disposed of.
