1. At the outset, learned counsel for the applicant submits that instant MCRC may be disposed of as withdrawn and the court below be directed to expedite the trial and decide it as early as possible.

2. On due consideration, instant MCRC is disposed of as withdrawn without any appreciation on its merit. The court below is directed to expedite the trial and decide it as early as possible preferably within a period of 4 months from the next date of hearing. Parties shall cooperate.

3. The applicant may file copy of the order before the trial Court for compliance. Registrar (Judicial) is also directed to send copy of the order to the trial Court for compliance through fax and usual mode. Sd/- (Chandra Bhushan Bajpai) Judge Pathak
