This is an application filed under Section 439 of the Cr.P.C. which is first bail application before this Court filed by the applicant for grant of regular bail. The applicant was arrested on 30-07-2016 in connection with Crime No.172/2016 registered at P.S. Champa, District JanjgirChampa, C.G. for the offence under Section 420, 409/34 of the IPC and Section 3, 4, 5, 6 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978 & Section 6, 10 of Chhattisgarh Protection of Depositors Interest Act, 2005.

It is submitted by learned counsel for the applicant that the applicant is suffering from severe disease in his leg which requires immediate treatment. Hence, it is prayed that for the requirement of treatment the applicant may be granted bail.

Learned counsel for the State/non-applicant has submitted a report called from District Jail Janjgir. The medical report attached shows that
-2the applicant has ailment of displaced patella, due to which he is able to walk with help of knee brace and surgery of tendon is required but that is not essential in the present stage.

Considered the submissions and the report submitted by the doctor from District Jail Janjgir-Champa. It is observed that if any surgery is required to be done with respect to the ailment of the applicant, then if so advised by the doctor of the jail concerned, the applicant be provided with all the medical facilities as far as rule permits for getting proper medical treatment for him.
