1. Heard.
2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.14/2017, registered at Police Station Katghora, District Korba (CG) for the offence punishable under Section 306 of IPC.
3. Deceased Nandini Jaiswal committed suicide by selfimmolation for the reason that the applicant used to blackmail her over mobile phone. A reading of the dying declaration of
the deceased would not disclose as to the exact nature of allegations on the basis of which the applicant used to blackmail the deceased. It is also not clear as to the relationship between the applicant and the deceased as both the applicant as well as the deceased are married, but there is no allegation of any affair between them.
4. Considering the nature of evidence available in the case diary, I am of the opinion that present is a fit case in which the applicant should be enlarged on regular bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
