1. This is the First Bail Application filed under Section 439 of Cr.P.C. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.32/2017, registered in Police Station Hirri, Distt. Bilaspur (C.G.) for offence under Sections 392, 120-B read with Section 34 IPC.
2. The applicant along with three other accused persons have committed loot of Rs.870/- from one vegetable vendor.
3. Learned State counsel would oppose the prayer for grant of bail on the ground that two accused persons are absconding.
4. Considering the fact that the offences are triable by JMFC, the applicant is in jail since last about 3 & 1⁄2 months and the charge-sheet
has already been filed, this Court is inclined to release the applicant on bail.
5. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
