AWARD (Passed on 9th March, 2019) 1.

A compromise petition (docket) has been filed by the contesting parties. 2.

This WPL has been brought by the petitioner challenging the Award dated 25-01-2018 passed by the State Industrial Court Raipur in Civil Appeal No.47/CGIR Act/A-II/2005 whereby the learned Industrial Court has partly allowed the appeal of the petitioner and only granted 50% back wages from the date of termination to date of reinstatement. 3.

As per the terms of the compromise, both the parties are agreed to following terms of compromise:- (1) As per order dated 22-01-05 passed by the Labour Court Jeevanlal Sahu will be reinstated w.e.f. 22-01-2005 with continuity of service & period of termination shall also be treated as continuity of service.

-2- (2) Jeevanlal Sahu shall not claim any back wages in future as order dtd. 25-01-18 passed by Industrial Court.

Petitioner in person and Shri S.D. Sori representing the respondent No.1 have given statement according to the terms as agreed between the parties.

The petitioner has prayed to withdraw this petition on the basis of aforementioned compromise.
