Shri Anant Bajpai, Panel Lawyer Hon'ble The Vacation Judge Order on Board 26/05/2017 The applicant has preferred this application under Section 439 Cr.P.C. for grant of bail as he has been arrested in connection with Crime No. 96 of 2017 registered at Police Station Bemetara District Bemetara (Chhattisgarh) for the offence punishable under Sections 363, 366, 376 of IPC and Section 5 (I), 6 of Protection of Children from Sexual Offences Act. 2.

Considering the fact that the prosecutrix is less than 18 years age and the allegation of commission of rape has been made even in the statement under Section 164 CrPC, this Court is not inclined to release the applicant on bail.
