Learned counsel for the applicant would submit that Newra police, District- Raipur, C.G. had filed the charge sheet against the applicant along with another co-accused Dinesh which is pending before the Additional Sessions Judge (FTC) Raipur, C.G. as Sessions Trial No.173/15. Police had also filed supplementary charge sheet against a juvenile Manoj before the Juvenile Justice Board Raipur, C.G. The trial is going on. The applicant is arrested on 22-05-2015 and the applicant is charged for the offence under Section 450 read with Section 34, Section 376(1), Section 506 read with Section 34, Section 307 read with Section 34 and Section 394 read with Section 34 of the IPC. The prosecutrix lodged false report against the applicant.

She is not appearing before the Court of Sessions for her examination, with this, the trial is not yet concluded and the applicant is in jail since long. Therefore, he may be granted bail. Learned counsel for the applicant would further submit that the applicant is not aware whether coaccused Dinesh and Manoj, juvenile, ever prayed for their release on bail before the High Court or not.

Per contra, learned counsel for the non-applicant/State opposed the argument advanced on behalf of the applicant.

On due consideration, looking to the facts surfaced in the charge sheet, charges have been framed against the applicant, I am not inclined to grant bail to the applicant.
