Agrawal Order On Board 03/04/2017 (1) The petitioner/accused has been convicted for offence under Section 420 of Indian Penal Code by learned Chief Judicial Magistrate, Raipur and he is in jail since 04th June, 2015 and if his appeal is not being heard finally, sentence is likely to be completed. (2) Learned counsel appearing for the petitioner/accused would submit that on account of record being requisitioned by this Court, his appeal is not being disposed of and his application for suspension has been rejected.
(3) After hearing learned counsel for the parties, the petition is disposed of with the following directions:- (i) The record of Criminal Case No.13022/2015 (State of
Chhattisgarh v. Maujiram Sahu alias Ravikant Sahu & Other) be sent to the Court of Additional Sessions Judge, Raipur for hearing and disposal of Criminal Appeal No.202/2016 (Maujiram Sahu alias Ravikant Sahu v. State of Chhattisgarh) expeditiously by the concerned Court. (ii) The Additional Sessions Judge, Raipur is directed to conclude and decide the appeal preferably within a period of one month from the date of receipt of copy of this order and record, considering the fact that the appellant/petitioner has already undergone one and half years of sentence. (4) In the meanwhile, petitioner/accused is directed to be released on bail on his executing a personal bond in the sum of Rs. 25,000/- with one surety in the like sum to the satisfaction of the trial Court.
He is directed to appear before the trial Court on each and every date given to him by the said Court till disposal of the appeal. (5) With the aforesaid direction, this petition is finally disposed of. A copy of this order be sent by Registry of this Court to the Additional Sessions Judge, Raipur for compliance of the order.
