1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.8/2017, registered at Police Station Lormi, District Mungeli (CG) for the offence punishable under Sections 381 & 411 of IPC.

3. The applicant is engaged as Cleaner on daily wages in the Punjab National Bank, Branch Khaprkala, Lormi. On the date of incident, he found Rs. 20 lakhs kept in the drawer of the table

of the Bank OfÏcer, which he took away and handed over Rs.4 lakhs to his brother-in-law Dhanesh Singh. When the Branch was opened and the amount was not found, the Manager reported the incident to the Police, on which, Rs.4 lakhs has been recovered from Dhanesh Singh and the remaining 16 lakhs was recovered from this applicant.

4. Learned counsel for the State would oppose the bail application.

Considering the fact that the entire amount has already been recovered; the applicant is in jail since 4.1.2017 i.e. for about 5 months and the offences are triable by the Judicial Magistrate First Class, I am of the opinion that present is a fit case, in which, the present applicant should be enlarged on regular bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
