Hon'ble Shri Justice P. Sam Koshy Order On Board 07.08.2019

1. The challenge in the present writ petition is to the order Annexure P-1 dated 12.07.2019 whereby the services of the petitioner have been transferred from Middle School Murkil, Bharatpur, District Koriya to Middle School Geji, Khadgawa, District Koriya.

2. The contention of the counsel for the petitioner is that the petitioner is a

physically challenged person and he has 40% permanent disability as is evident from Annexure P-5 issued by the District Medial Board. He submits that the place where the petitioner is now being transferred is a remote area and therefore he would find difficult to have sufficient means of transport and to have easy access to the said place.

3. Given the limited grievance that the petitioner has raised, let the petitioner make a detailed representation in this regard to the respondent no.2 within a period of 15 days from today and the respondent no.2 in turn shall consider and decide the same within a further period of 30 days from the date of receipt of representation of the petitioner.

4. Till the representation of the petitioner is decided, there shall be stay of the effect and operation of the impugned order so far as the petitioner is concerned.
