Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 4-101. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.

2. The applicant has been arrested in connection with Crime No.84/2017 registered in police station Ramanuj Nagar, Distt. Surajpur (CG) for offence punishable under Sections 363, 366 of the IPC and under Section 18 of the Prevention of Children from Sexual Offences Act.

3. Prosecution story in brief is that on 29-4-2017 the prosecutrix was about 15 years old. She is a resident of village Lachha. On 29-4-2017, the applicant took the prosecutrix by enticing on the pretext of marriage.

4. Counsel for the applicant argued that the applicant is innocent and falsely implicated hence he be released on bail. He further argued that the applicant and the prosecutrix are brother and sister.

5. On the other hand, the Panel Lawyer appearing for the State opposed the bail application.

6. Looking to the facts and circumstances of the case, looking to the impact of granting bail to the applicant on the society, this Court is not inclined to grant bail to the applicant.

7. Consequently, the MCRC is dismissed.
