Learned counsel for the applicant would submit that the applicant held arrested in connection with Crime No.232/14 by P.S. Kanker, District North Bastar Kanker, C.G. for the offence under Section 419, 420, 465, 468, 471 of the IPC on 10-2-2016. Since more than a year the applicant is in jail. After investigation charge sheet has been filed, the matter is pending before the CJM Kanker for trial. The trial is not concluded in Criminal Case No.310/2016. As per the allegation, he is taken Rs.70,000/- from Geman Sahu, Rs.70,000/- from Dogendra Sahu and assured them that he will get them appointed in police department and he gave them false appointment letter. Looking to the period of detention, the applicant may be granted bail. 3.
Per contra, learned counsel for the non-applicant/State opposed the argument advanced on behalf of the applicant. 4.
On due consideration, looking to the entire facts collected and also the fact that till date the applicant not returned alleged money taken on the false pretext to the complainants, I am not inclined to grant bail to the applicant.
