1. Heard.

2. The case of the petitioner is that he moved an application for grant of Caste Certificate under the Chhattisgarh Lok Sewa Guarantee Act, 2011, but till date the competent authority has not issued Caste Certificate of the petitioner. Learned counsel for the petitioner submits that due to the inaction upon the competent authority i.e. respondent No. 3, in not issuing the Caste Certificate within the prescribed time, he preferred the appeal before the 2nd respondentthe Collector who also has not taken any steps to decide the appeal.

3. After perusal of Annexure- P/1 as well as other relevant documents annexed alongwith the matter, specific question was put that whether the conditions mentioned under Clause-2 of Annexure-P/1 has been complied with and

relevant documents are submitted or not. Learned counsel for the petitioner could not able to point out the compliance as required in Annexure-P/1.

4. From the documents annexed along with the writ petition, it does not appear that the petitioner has submitted the documents which is mentioned in serial no. 2 of Annexure-P/1.

5. Learned counsel for the petitioner submits that the petitioner may be permitted to withdraw the writ petition with liberty to file afresh along with all relevant documents and better constituted petition. Petitioner is allowed to withdraw the writ petition with aforementioned liberty.
