1. The challenge in the present Writ Petition is to the order Annexure P1 dated 12.07.2019, whereby the petitioner has been transferred from Middle School, Khoddal, Block: Korba to Girls Hostel Middle School, Shyang, Block: Korba.

2. The ground of challenge is that, the petitioner and his wife are working under the respondents and are presently at the same place

-2and now by the impugned order, the petitioner has been sent/transferred to a place more than 100 Kms. Thus, the order of transfer becomes violative of the present policy of the State.

3. The counsel for the petitioner further submits that, the petitioner has been transferred at the behest of the Respondent No. 4 who has been transferred at the place of petitioner on his own request.

4. Given the aforesaid facts of the case, let the petitioner make a detailed representation to the Respondent No. 02 within a period of 7 days from the date of receipt of the said representation, the Respondent No. 02 in turn may consider the grievance of the petitioner and pass an appropriate order by accommodating the petitioner somewhere nearby, thereby the family does not get disturbed.

5. Till the representation is decided by the Respondent No. 02, there shall be a stay of the effect and operation of the impugned order Annexure P-1, so far as the petitioner is concerned.
