Hon'ble Smt. Justice Rajani Dubey Order on Board 25.03.2021 The applicant has filed this bail application under Section 439 of the Code of Criminal Procedure for grant of regular bail in connection with Crime No. 223/2020 registered at Police Station: Dharsiva, District Raipur (C.G.) for the offence punishable under Sections 394, 395, 328, 398, 120-B, 412 of the IPC and Sections 25 & 27 of Arms Act.

As per the prosecution case, the allegation against the present applicant is that on 24.06.2020 at about 4.00 AM, while the complainant was going to Prakash Industries Raipur driving a truck bearing Registration No. C.G. 04 JC 8440, at that time the applicant along with other co-accused persons came near the truck in a Scorpio, pulled out the complainant from the said vehicle, looted Rs. 16,500/- from him and fled away towards the Raipur with the said

truck.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. He further contended that the applicant is in jail since 25.06.2020 and he is ready to furnish adequate surety and shall abide by all the conditions and directions, which may be imposed by this court, therefore, the present applicant may be released on bail.

Per contra, learned State counsel opposes the bail application. I have heard learned counsel for the parties and perused the case diary.

Considering the totality of the facts and circumstances of the case, nature and gravity of the crime, at this stage, I am not inclined to release the present applicants on bail.

Accordingly, his application filed under Section 439 of the Code of Criminal Procedure is rejected.
