27.11.2020 Shri Rajesh Kumar Kesharwani, Advocate for the petitioner. Shri Sabyasachi Bhaduri, Advocate for the respondents. The challenge in the present writ petition was to the order dated 28/31.08.2015 whereby the services of the petitioner was placed under suspension.
The counsel for the petitioner submits that subsequently the petitioner was also issued with charge sheet dated 12.10.2015 and this court in the present writ petition had granted interim protection to the extent of disciplinary proceedings may go on but no final order should be passed vide order dated 05.01.2016.
By efflux of time, the petitioner has now crossed the age of superannuation on 31.03.2020. The petitioner was retired from service also while being under suspension.
In view of the fact that the petitioner has now retired from service w.e.f. 31.03.2020, the grievance so far as suspension part is concerned, the same again stands rendered infructuous except for the relief of how the suspension period has to be treated in the event if the petition whereby the challenge to the charge sheet is allowed in favour of the petitioner, which shall be considered in the said writ petition i.e. WPS No.3955 of 2015. The writ petition therefore stands disposed of as having become infructuous leaving open the issue of consequential benefits to be considered in the other connected writ petition of the petitioner i.e. WPS No.3955 of 2015.
