Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 2-71. The petitioner has preferred this writ petition praying for direction to the respondent-authorities to pass orders for continuance of his services and to revoke the order of termination Annexure P-1 dated 11-3-2015.

2. The petitioner was appointed as Chaukidar in the Water Resources Division, Mungeli on 14-6-2011. On 29-12-2012 he has been regularized. Thereafter on 11-3-2015 he was terminated.

3. Counsel for the petitioner submits that the writ petition may be

disposed of with a direction to be given to the respondent No. 2 that he may dispose of his represention which was received on 26-6-2018 by the respondent No. 3 in the light of the decision of Hon'ble Supreme Court in Avtar Singh -v- Union of India and others reported in [(2018 1 SCC 268)].

4. Looking to the facts and circumstances of this case, this writ petition is disposed of with the direction that the respondent No. 3 shall decide the aforesaid representation of the petitioner in the light of the decision of Hon'ble Supreme Court in Avtar Singh (supra) within a period of two months from the date of receipt of a copy of this order in accordance with law and procedure.

5. It is made clear that this Court has not expressed any opinion on the merit of the case.
