Hon'ble Shri Justice Goutam Bhaduri Order on Board 01.10.2021 Heard

1. The instant petition is filed on the ground that the petitioner contested election for Member of Jila Panchayat, Balrampur and he lost the election by 6 votes. Learned counsel for the petitioner would submit that despite raising objection for recounting, it was not considered and eventually a election petition has been preferred by the petitioner before the Director of Panchayat, Raipur. He would further submit that the election was declared on 06.02.2020 and prays that election petition may be directed to be decided within a stipulated time as

otherwise the filing of the election petition itself would become infructuous.

2. Perused the documents.

3. Considering the order sheet and without going into the merits of this case, it is observed that since the election petition has already been preferred by the petitioner on 28.02.2020 and more than 1 year has already passed, taking into such facts and further considering the fact that evidence has already been recorded, it is directed that the Director Panchayat shall decide the election petition preferred by the petitioner within a period of 4 months from the date of receipt of a copy of this order.

4. With the aforesaid observation the petition stands disposed of. Sd/- (Goutam Bhaduri) Jyoti Judge
