This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.74/2017 registered at Police Station- Gol Bazar, District Raipur (C.G.) for the offence punishable under Sections 420, 468, 471 of Indian Penal Code. 2.
As per the prosecution case, the applicant applied for the post of Librarian in the Jila Panchayat, Raipur in the year 2013 and got the job on the basis of fake mark sheets of B.Lib and ISC of Guru Ghashi Das University and when the mark-sheet was verified by the University, it was found to be forged.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and actually no documents were submitted alongwith the application at the time of procurement of the employment. He would further submit that the
charge-sheet has been filed and no further investigation would be necessary. He would lastly submit that the applicant is in jail since 26/03/2017 and he has not committed any offence, therefore, he may be enlarged on regular bail.

On the other hand, learned counsel for the State opposes the prayer for grant of bail.

Perused the case diary and the documents. Taking into consideration the fact that the charge-sheet has already been filed and all the evidence appears to be documentary in nature and the applicant is in jail since 26/03/2017, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. 8.
