Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 02/12/2019 Heard.

1. This contempt petition has been filed alleging willful disobedience of the order dated 07.03.2018 passed by this Court in WPS No. 4765 of 2005.

2. At the outset, learned counsel for the respondents submit that the order passed by this Court was assailed by filing a writ appeal and the Writ Appellate Court partly allowed the appeal. Actual monetary benefits during which the petitioner remained in service were not granted and only notional fixation was directed for consideration of promotion. It is further submitted that later on, review petition was also dismissed by the Division Bench.

3. It is informed to the Court and has also been stated in the reply that in compliance of the order passed by this Court and by the Division Bench in the writ appeal, the petitioner's case for promotion was considered by holding review DPC and he has been granted notional promotion to the post of Ranger w.e.f. 31.12.1995. On that basis, the petitioner's salary has been refixed notionally and consequently, his pension case has also been revised and all arrears of pension has also been paid and current pension on higher basis is also being paid.

4. These facts are not disputed by the petitioner.
