Grievance of the Petitioner in the instant case is that the Petitioner has been deprived of employment in spite of his/his relatives' land has been acquired by the Respondent-SECL.

Learned Counsel for the Petitioner submits that his case ought to have been considered under the Scheme of R & R policy applicable at the time the acquisition of land was made. He further submits that the Respondent-SECL has already issued a letter to Naib Tahsildar to conduct an enquiry so far as the actual date of birth of the Petitioner is concerned. He next submitted that since a writ petition meanwhile has been filed by the Petitioner, the Naib Tahsildar has kept the file of enquiry in abeyance. The Petitioner therefore makes a limited prayer that the present writ petition may be disposed of with a direction to Naib Tahsildar to conduct an appropriate enquiry and thereafter a detailed report be submitted to the Respondent-SECL on the basis of which the management of SECL shall take a suitable decision.

Considering the limited nature of prayer made by the Petitioner and also the fact that the Respondent-SECL on an earlier occasion also had sent a matter for enquiry before the Naib Tahsildar, this Court is of the opinion that no fruitful purpose would be served in keeping the petition pending any further rather ends of justice would meet if a direction is given to the Naib Tahsildar, Up-tahsil Dipka to conduct an enquiry as has been sought for by the SECL and to submit a detailed report to the management of SECL who in turn may pass suitable orders on the basis of the said report.

The writ petition stands accordingly disposed of with the aforesaid directions.
