2. The applicant has preferred this application for grant of bail as he is arrested on 25-9-2016 in connection with Crime No. 156/2016 registered in PS Gidhauri for offence punishable under Section 302 of the Indian Penal Code, 1860.

3. Learned counsel for the applicant submits that after investigation charge sheet has been filed and the same is pending before the 3rd Additional Sessions Judge, Baloda Bajar as ST No. 67/2016. The applicant is arrested as the prosecution alleges that he murdered Amrika Bai, sister-in-law and Ku. Ritu Sahu, his niece. The evidence collected during investigation is hearsay hence in the instant matter, the applicant may be enlarged on bail.

4. Per contra, learned State counsel opposes the bail application and submits that Sadanand Sahu, eye-witness has seen the

incident which goes to show that the applicant murdered his sister-in-law and niece.

5. Perused the entire material.

6. Considering the statement of Sadanand Sahu recorded under Section 161 of the Cr.P.C. and other material collected against the applicant and looking to the entire act, where deceased Amrika Bai and Ku. Ritu Sahu lost their lives, I am not inclined to grant bail to the applicant.
