The applicant has preferred this first bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.210/2020, registered at Police Station Punjipathara, District Raigarh (CG), for the offence under Sections 354C, 354D, 384, 392, 506-B, 34 of the Indian Penal Code.

This applicant along with co-accused Tarun Sahu & Chhavilal were involved in stalking and thereafter collecting obscene

photograph of the prosecutrix and her fiance (मगेतर). Thereafter, co-accused persons allegedly demanded Rs.2.00 lacs as extortion money for not circulating the obscene photographs, however, when the amount was not paid co-accused Tarun Sahu send the obscene photographs and video clipping in the mobile phone of the brother of the prosecutrix.

Learned counsel for the State, per contra, would oppose the bail application.

Considering that the allegation of circulating obscene photographs has been levelled mainly against Tarun Sahu and not against this applicant and further considering the fact that he is in jail since 24-10-2020 and the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
