The applicant has preferred this first bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.312/2020, registered at Police Station Naila, Janjgir, District Janjgir-Champa (CG), for the offence under Sections 381, 411, 34 of the Indian Penal Code.

Applicant along with co-accused persons have committed theft of Tullu Pump/Submersible Pump and crackers from the shop of the complainant Pawan Agrawal.

Co-accused Dinesh Kumar @ Chhotu has already been released on regular bail by order dated 28-9-2020 passed in M.Cr.C.No.6240 of 2020. Another co-accused Prince Kumar Raja has also been released on regular bail by order dated 9-10-2020 passed in M.Cr.C.No.5563 of 2020. Present applicant is in jail since 13-7-2020 and the offences are triable by the JMFC, therefore, considering the fact that the co-accused have already been released on regular bail, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
