The applicant has preferred this first bail application under Section 439 of CrPC for grant of bail, as he is arrested in connection with Crime No.280/2021, registered at Police Station Bhilai, District Durg for the offence punishable under Section 307 read with Section 34 of IPC.

The case of the prosecution in brief is that when the victim was going towards Gandhi Chowk, he was assaulted by the applicant and other co-accused by a knife, as a result of which he sustained serious injuries.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the crime in

question. He further submits that the applicant is a young boy, aged about 20 years and there is no other previous criminal antecedents of him nor there is likelihood of his absconding. The applicant is in jail since 28.06.2021 and the charge sheet has already been filed, therefore, he may be enlarged on bail. 4.

On the other hand, learned State counsel opposes the bail application.

I have heard learned counsel appearing for the parties and perused the case diary.

Taking into consideration the facts and circumstances of the case, nature and gravity of the offence, for the fact that the applicant has actively participated in the offence and also looking to the injuries sustained by the victim, this Court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. However, the Trial Court is directed to expedite and conclude the trial within 6 months.
