Heard the matter finally.

Learned counsel for the applicants would submit that the applicants held arrested in connection with Crime No.43/16 on 05-07-2016 by Chandrapur police, District Janjgir-Champa, C.G. for the offence under Section 379, 34 of the IPC. After investigation police had filed the charge sheet against the applicants which is pending before the JMFC Dabhra, District Janjgir-Champa, C.G. registered as Criminal Case No.461/16. This Court while hearing MCRC No.7997/16 dismissed the bail petition of co-accused. As per the allegation, the applicants have stolen Tata Indica Car CG 08 K 1753. The applicants are in jail since long. The matter is triable by Magistrate First Class. The applicants shall abide by the terms and conditions imposed by this Court. They may be granted bail.

Per contra, learned counsel for the non-applicant/State opposed the argument advanced on behalf of the applicants and would submit that against the applicants total four crime number in connection with theft of vehicle have

-2been registered. The co-accused was denied for bail by this Court. Looking to the entire facts surfaced, the instant MCRC may be dismissed. 4.

Perused the entire material.

On due consideration, looking to the facts surfaced in the matter and as many cases have been registered against the applicants for theft of vehicle, I am not inclined to grant bail to the applicants. Consequently, the instant MCRC is hereby dismissed.
