This is repeat application for grant of bail.

1. Learned counsel for the applicant would submit that though earlier bail application was considered and rejected, liberty was given to revive in case trial is not commenced/concluded and the applicant completes one year of pre-trial detention.

2. On the other hand, learned counsel for the State opposes the prayer and submits that at present trials are going on and the Courts have started functioning physically with effect from 17.11.2020, therefore, in a matter like this, at this stage, direction for expeditious conclusion of trial may be issued instead of granting bail.

3. Learned counsel for the applicant would submit that merely because the allegations against the applicant are stated to be serious in nature, he could not be kept in jail for a long time.

4. Taking into consideration the period of pre-trial detention of the applicant and weighing it with the seriousness of the allegation of having committed offence of rape against the minor girl, the applicant is not entitled for grant of

-2bail. The application is therefore rejected. The trial Court is directed to conclude the trial as early as possible within three months without granting any adjournment to any of the parties and if necessary to direct witnesses to appear in the Court through coercive process.
