Hon'ble Shri P. Sam Koshy, J Order On Board 09/03/2015 The petitioner, through the petition is challenging the order dated 26.11.2011 (Annexure P-1) by which the service of the petitioner from the post of Siksha Karmi Grade-1 was terminated.

Conscious of the fact that the petitioner has preferred the instant Writ Petition at a belated stage of more than 4 years, the petitioner prays for withdrawal of the writ petition at this juncture with a liberty to approach the appellate authority by preferring an appeal against the impugned order dated 26.11.2011.

State counsel does not have any objection in this regard. However, the only point involved in the argument made by counsel for the State is that there is a considerable delay on the part of the petitioner in
approaching this Court and that during this period, he had also not preferred the statutory remedy of appeal.

Taking into consideration the facts and circumstances of the case without expressing anything on the merits of the case, the petitioner is permitted to withdraw the present Writ Petition with liberty to approach the appellate authority.

Accordingly, the instant Writ Petition (S) stands dismissed as withdrawn with the liberty as prayed for.
