1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.473/2020, registered at Police Station Bhatapara Gramin, Distt. Baloda Bazar Bhatapara, for the offence punishable under Section 306 of the Indian Penal Code.

2. It is alleged that the applicant was not paying Rs.10.00 lacs to Jitendra Dhruw (since deceased) as a result of which the deceased committed suicide on 13-6-2020.

3. Learned counsel for the applicant would submit that the deceased was the employee of the applicant, therefore, the allegations are baseless.

4. Learned counsel for the State, per contra, would oppose the bail application.

5. The deceased committed suicide on 13-6-2020 whereas the FIR was lodged on 1-11-2020 i.e. after almost 5 months. In the statement of Shambhu Dhruw, brother of the deceased, it has been informed to the police that the deceased was working with the applicant, who is an Electrical Contractor. Thus, it is unbelievable that the deceased, who was working as labourer with the applicant, would give loan of Rs.10.00 lacs to the applicant.

6. Considering the nature of allegations and for the delay in lodging the FIR, this Court is inclined to release the applicant on anticipatory bail.

7. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- • he shall make himself available for interrogation by a police officer as and when required;

• he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.

• he shall not influence the witnesses during pendency of the trial.
