On due consideration, I am satisfied that the petitioner has succeeded in explaining the cause of delay in filing the appeal and therefore, the application is allowed.

Delay of 17 days in filing the appeal is hereby condoned. Also heard on application for grant of leave to appeal under Section 378(3) of the CrPC.

On due consideration, leave is granted.

Let the CrMP be registered as regular Acquittal Appeal. Also heard on admission of the acquittal appeal. Issue notice to the respondent.

Bini Shri Uttam Pandey, learned counsel for the respondent accepts notice on behalf of the respondent.
