The State was directed to get the victim examined and submit report as to whether the termination of pregnancy is possible or not. The medical report which has been placed on record shows that at present, the victim is carrying the pregnancy of 28-30 weeks and it would not be proper to terminate her pregnancy.

Further a perusal of Sub-section (2) (b) of Section 3 of The Medical Termination of Pregnancy Act, 1971 shows that the termination cannot be ordered if the length of pregnancy exceeds 20 weeks. After perusal of the medical report and in view of sub-section (2)(b) of the Act, at this stage, no order for termination of pregnancy can be ordered by this Court.
