The limited relief that the petitioner has sought for in the present writ petition is for an appropriate direction to the respondents to consider the case of the petitioner for appointment on the post of Lab Technician under NVBDCP programme on contractual basis in the unreserved open category. 2.

The contention of the petitioner is that, the petitioner who had participated in the selection process for the post of Lab Technician was placed at Sl. No.1 in the waiting list. There was only one post advertised and the person who was selected on the said post was one Basant Kumar Bargah. The record shows that the said Basant Kumar Bargah, the selected candidate, is reluctant to join on the said post, as is evident from Annexure P-5. Under the circumstances, the post has be filled in by the candidate whose name appeared at Sl. No.1 in the waiting list, which is that of the petitioner. Annexure P-4 is the document which shows the select list and the waiting list.

In view of the aforesaid limited grievance that the petitioner has and the respondents having not taking a decision in this regard in spite of the petitioner having approached the authorities on repeated occasion, this Court is of the opinion that ends of justice would meet if the respondents no. 2 and 3 take an appropriate decision at the earliest to consider the case of the petitioner so far

as the claim for appointment to the post of Lab Technician is concerned, in the light of his name being reflected in the select list (Annexure P-4). 4.

Let an appropriate decision be taken in this regard preferably within a period of 60 days from today.
