1. Heard.

2. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.129/2020, registered at Police Station Marwahi, Dist. Gaurela-Pendra-Marwahi C.G. for the offence punishable under Sections 323, 354, 354B, 452 of the I.P.C.

3. As per the prosecution case, applicant outraged the modesty of the prosecutrix, a widow lady aged about 26

MCRC No. 8431 of 2020 years on 05.11.2020 when she was attending her duties at an Anganbadi center. The applicant allegedly picked up a quarrel by saying as to why she has blocked his number and not involved in conversation. The prosecutrix was manhandled for which she has sustained simple injuries.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering that the offences are triable by JMFC and also for the fact that the applicant is in jail since 5.11.2020; charge-sheet has already been filed, I am inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
