1) The applicant has preferred this application under Section 438 of Code of Criminal Procedure, 1973 for grant of anticipatory bail as he apprehends his arrest in connection with Crime No. 659/2021 for the offence punishable under Section 376 of IPC registered at Police Station- Kota, District- Bilaspur (C.G.).

2) After arguing for sometime, learned counsel appearing for the applicant seeks to withdraw this application. However, she submits that a direction be issued to learned Court below concerned that if applicant surrenders and files an application for grant of regular bail, the same may be decided on same day.

3) Learned State counsel submits that he is having no objection to the prayer made by learned counsel for the applicant.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn. If applicant files an application for grant of regular bail after his
