1) The present appeal i.e. CRA No. 1169/2021 and previously filed appeal CRA No.1139/2021 are arising out of the same judgment of conviction and order of sentence dated 31.08.2021 passed by the Additional Sessions Judge, Balod, District- Balod (C.G.) in Sessions Trial No. 52/2018. Previously filed appeal i.e. CRA No. 1139/2021 has been preferred by the same appellant namely Bhagchand Khelwar through his counsel Shri Amit Singh Chouhan whereas subsequent appeal i.e. CRA No. 1169/2021 is filed on behalf of same appellant through High Court Legal Services Committee. Since two appeals against the same judgment of conviction and sentence are not maintainable, in the facts and circumstances of the case, the appeal i.e. CRA No. 1169/2021 is dismissed as not maintainable.

2) List CRA No. 1139/2021 for hearing in its due course.
