This is second bail application under Section 439 of Cr.P.C. The earlier bail application was dismissed on 6/07/2021 vide M.Cr.C. No.1922/2021.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.29/2017 registered in Police Station Basantpur, District- Balrampur-Ramanujganj, Chhattisgarh for offence punishable under section 302 of Indian Penal Code. 3.

As per the prosecution case on 31/10/2017 the applicant committed murder of his wife by beating her by club and strangulated her by club. 4.

Learned counsel for the applicant submits that seven witnesses have been examined and the applicant is in jail since 16/05/2017, therefore the applicant may be released on bail. 5.

Learned State counsel opposes the prayer for grant of bail. 6.

After perusal of the earlier bail order dated 6/07/2021 wherein name of one eye witness has been shown that he has seen the incident,

eye witness Saugand has still not been examined, therefore I do not find any change of circumstances to reconsider the bail again. 7.
