1. Heard.

2. The applicant has preferred this bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.48/2020, registered at Police Station Karpawand, District Bastar (C.G.) for the offence punishable under Sections 364, 302, 120 B, 201 and 34 of the Indian Penal Code.

3. As per statement of Kaushilya Thakur, mother of deceased Gopal, the present applicant Lachan Kashyap alongwith co-accused Roopdhar, and Raju Baghel kidnapped the deceased from his house and thereafter his dead body was found after two days.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the nature of allegation and the evidence available on record, I am not inclined to release the applicant at this stage.

6. Accordingly, the bail application is dismissed with liberty to revive the prayer after examination of material witnesses and Kaushilya Thakur. SD/- (Prashant Kumar Mishra) Judge Amardeep
