1. Heard on I.A. No. 1/2017 for urgent hearing.
2. On due consideration, I.A. No. 1/2017 is disposed of.
3. Learned counsel for the applicant submits that the applicants are in ad-interim bail as per order passed by the 1st Additional Sessions Judge, Mahasamund till 3-5-2017. With the above they are presently on ad-interim bail and not surrendered yet and the prayer for regular bail is rejected on 10-4-2017. The quantity of liquor seized from the joint possession of the applicants is 57 bulk litre along with a 4 wheeler SUMO registration No. CG 17 D 1588.
4. On due consideration as the applicants are presently on ad-interim bail, they have not surrendered as directed and their prayer for regular bail has been dismissed, I am not inclined to hear the matter unless the applicants surrender before the concerned court and again pray for release on bail under Section 439 of the Cr.P.C. The applicants are directed to surrender first before the concerned court and thereafter along with entire certified copy showing grant of bail, surrender etc
may file MCRC afresh, if they so advised.
5. MCRC is accordingly disposed of.
