1. Learned counsel for the petitioner would submit that open land adjoining her shop has been handed over to him by executing agreement (Annexure-P/3), which provides, inter alia, that if the Nagar Panchayat needs open land, the same can be got vacated after notice of 3 months.

2. It appears, the petitioner is trying to enforce the terms of the contract between her and the Nagar Panchayat.

3. Let the petitioner avail alternative remedy for enforcing terms of the contract, which is not amenable to the writ jurisdiction of this Court under Article 226 of the Constitution of India.
