Hon'ble Shri Justice P. Sam Koshy Order On Board 24.08.2018 There are two reliefs sought for by the petitioner in this writ petition. One is for a direction to the respondents for grant of maternity leave and second is for releasing the unpaid salary for the period from 28.04.2011 to 20.07.2011.

So far as the unpaid salary part is concerned, in the light of the observation made by the Block Education Officer dated 09.10.2013 Annexure P-3, let the petitioner make a detail representation in this regard to the Block Education Officer i.e. respondent no.4 within a period of 4 weeks from today and on receipt of the said representation, the respondent no.4 shall decide the claim of the petitioner within a further period of 60 days so far as the issue of unpaid salary for the aforesaid period is concerned.

So far as granting of maternity leave is concerned, the said issue has already been decided by this Court in the case of Devshree Bandhe vs. Chhattisgarh State Power Holding Company Limited and others in WPS 101/2017. The said judgment has also been reiterated in WPS No. 3365 of 2017 decided on 26.07.2017 in the case of Dr. Vijay Laxmin Chandra vs. State of Chhattisgarh and others. 4.

In the light of the aforesaid judgments passed by this Court, the present writ petition deserves to be and is accordingly allowed with a direction to the respondents to ensure that the petitioner is provided with all maternity benefits at par with the government employees. 5.
