1. The grievance of the petitioner in the present case is that the claim of the petitioner for compassionate appointment was turned down on the ground that she does not possess the minimum requisite qualification for the appointment on the post of Assistant Teacher (Panchayat).

2. At this juncture, counsel for the petitioner submits that as the petitioner does not possess the minimum requisite qualification for her appointment on the post of Assistant Teacher (Panchayat), the respondents be directed to consider her case for compassionate appointment as a Class IV employee like Peon etc., to which the counsel for the State submits

that if the petitioner makes a fresh representation in this regard, the respondents shall consider and decide the case of the petitioner in accordance with rules.

3. In view of the above, it is directed that on petitioner's making fresh representation for compassionate appointment stating that as she does not possess the requisite qualification for the post of Assistant Teacher (Panchayat), she has no objection if she is granted compassionate appointment as a Class-IV employee like Peon etc., the respondent authorities, in turn, shall consider the same and pass an appropriate orders preferably within a period of three months from the date of receipt of the fresh representation.
