The present MCC has been filed seeking restoration of the WPS 2987/2021 which got dismissed by a peremptory order passed by this Court on 27.07.2021.

Counsel for the applicant submits that the default has already been cured by the applicant on 06.08.2021. However, the Registry has shown the receipt of the same on 09.08.2021 and as such the writ petition got dismissed on a peremptory order by this Court.

Considering the entire facts and circumstances of the case, this Court is of the opinion that a strong case for restoration has been made out. Accordingly, the MCC stands allowed and WPS/2987/2021 stands restored to its original number. In case of any other default in the writ petition, the petitioner should cure the same within a period of 10 days' time. Let this order be made part of records of WPS/2987/2021. Sd/- (P.
