The grievance of the petitioner in the instant Writ Petition is that, though the petitioner was qualified and eligible for being promoted from the post of Superintendent Engineer to the post of Chief Engineer and for which a DPC also was held on 25/09/2017, but no decision have till date be taken on the said recommendation made by the DPC.

The counsel for the petitioner submits that, it is almost 1 year that the petitioner is waiting for the outcome and recommendation made by the DPC and thus prayed for issuance of direction to the respondent No.1 to hold DPC at the earliest in the light of the order passed by the Chief Secretary, Government of C.G. dated 16/02/2015 whereby it has been reiterated by the
Chief Secretary that all measures should be taken to hold the DPC regularly if not annualy.

Given the aforesaid grievance of the petitioner this Court does not intend to keep the Writ Petition pending, rather ends of justice would meet if the Writ Petition is disposed off with a direction to the respondent No.1 to immediately take steps for giving effect to the directions given by the Chief Secretary vide Annexure P/1 dated 16/02/2015 and also take all necessary steps for holding DPC at the earliest.

Let the process for holding the DPC by the competent authority under the Rules be taken within a period of 90 days from today. 5.
