The limited grievance of the petitioner in this petition is that though 17 posts of Junior Assistant are lying vacant, the petitioner was not considered for promotion from the post of Peon to Junior Assistant.

Learned counsel for the petitioner submits that though process was initiated, the respondents have suddenly developed cold feet and the process is not being completed.

On the other hand, learned counsel for the respondents submits that presently, proposed Rules governing terms and conditions of eligibility and procedure for promotion have been framed by the respondents and the aforesaid proposed Rules have been sent to the government for approval only on 09-11-2015. The aforesaid facts have been averred by the respondents in their return also. 4.

The text and tenor of reply of the respondents only goes to show that the proposed Rules governing terms and conditions of eligibility and procedure for promotion have not been finalized till date. Therefore, in these circumstances, no useful purpose would be served in keeping the matter pending. 5.

Accordingly, the petition is finally disposed off with a direction that the respondents shall make all endeavour to finalize the Rules as early as possible and the State Government shall also take decision in the matter of proposal of proposed Rules as early as possible so that the petitioner's case may be considered to the next higher post. The respondent-Corporation with due coordination of the State Government consider the case of the petitioner and other eligible employees for promotion by properly convened DPC and the applicable Rules.
